1. GENERAL

 

1.1 The contract for training conditions (hereinafter „Conditions“) for sports gym Võimla (hereinafter „Gym“) states the relations, rights, and obligations between the Gym and its trainees (hereinafter „Trainee“). The Conditions are accompanied by the Gym’s Internal Rules which can be found on the Gym’s website.

 

1.2 All members must read the Conditions and Internal Rules of the Gym before they start trainings in the Gym and confirm their agreement with their signature. This agreement is considered as a contract between the Gym and the Trainee.

 

1.3 Training in the Gym is allowed for adults and children from the age of 15 (included). Children under the age of 15 are allowed to train in the Gym with the written consent of their parent or guardian. The consent stipulates that the parent or guardian is in agreement with the Conditions and Internal Rules of the Gym and that they assume co-responsibility for fulfilling the obligations set for the Trainee.

 

1.4 The Conditions apply to all people while training in the Gym or while they wish to be associated with the Gym in any way.

 

 

2. TRAININGS

 

2.1 Trainings take place in various training groups according to set schedule. The Gym also reserves the right to offer extra trainings outside of set schedule and to provide personal trainings. The general training schedule and the information about extra trainings can be found on the Gym’s website. Personal trainings are arranged individually between the Trainee and the coach. The Gym has the right to make changes to the general schedule without giving prior notice. The Gym notifies its members of unexpected changes via e-mail, social media, or its website.

 

2.2 Trainings take place in two different training groups according to the level of the Trainee:

 

2.2.1 Beginners’ course: the aim of the course is to teach basic skills in their chosen sport.

 

2.2.2 Advanced level where the aim is to complement existing skills and strive for constant development.

 

2.3 Trainee is able to train in a group that is in accordance with their level of competence. Beginners’ course is for Trainees without prior experience in the sport. Trainee must attend at least 2/3 of the trainings in the course to pass this level. All Trainees who successfully complete the beginners’ course can move on to the advanced level. Trainees with sufficient knowledge and skill are able to train in the advanced level. The suitable level for the Trainee is decided by the representative or head coach of the Gym.

 

2.4 Each Trainee must register for the trainings by presenting their personal QR or numeral code to the coach. If the Trainee does not have a personal code they are to be registered by name.

 

2.5 If the Trainee does not have an active membership status in the time of training (i.e. their training fee is not paid) they must pay the fee for a single training.

 

2.6 Attendance is checked during the beginners’ course. The coach has the right to deny access to Trainees who have not paid their course fee.

 

2.7 The coach is to be informed about all problems and concerns that arise during training.

 

2.8 The coach has the right to deny trainings to the Trainee when danger to the Trainee or other members arises or if the Trainee does not adhere to the Conditions and/or Internal Rules of the Gym.

 

 

3. MEMBERSHIP FEES

 

3.1 Before the beginning of trainings the Trainee must ensure the payment of their membership fee, one-time training fee, or the payment for the beginners’ course.

 

3.2 The training fee guarantees access to all trainings in the groups that are suitable for the Trainee’s level. The time period for which payment is possible is set by the Gym. There is also the possibility to pay a one-time fee for one training. The period payment is valid from the beginning date of the payment until the same date next month(s).

 

3.3 In addition to advanced levels the training fee allows the Trainee to attend a beginners’ course if there are vacancies. The Trainee must send a letter to the Gym or register online to attend a beginners’ course. Trainee’s membership fee must be paid in full for the whole duration of the beginner’s course before the beginning of the course. The Trainee is under obligation to successfully complete the beginners’ course by attending at least 2/3 of the trainings. If the Trainee does not complete the course successfully the Gym has the right to demand compensation in the full sum of the beginners’ course.

 

3.4 Membership fees are non-refundable.

 

3.5 The membership fees cannot be paused or postponed to a later date. In the case of an injury the Trainee has the right to apply for a suspension of payment during the period when they are unable to train. This requires a written request and a medical proof of injury. The minimal period for the suspension is two weeks and the Trainee is obligated to inform the Gym in written form before returning to trainings.

 

3.6 For visitors the first training in intermediate or advanced group is free. The visitor must register to the training via the Gym’s website or fill out a registration form received from the coach. The Visitor must sign an agreement to all Conditions and Internal Rules of the Gym before training.

 

3.7 Beginners’ course fee guarantees the Trainee access to the trainings of the beginners’ course. The amount and the details of payment are set by the Gym and can be accessed on the Gym’s website. The Gym has the right to demand an advance payment to guarantee a place in the beginners’ course. The advanced payment and the course fee are non-refundable.

 

3.8 The price list is set by the Gym and it is published in the Gym’s website. The Gym has the right to apply discounts, organize campaigns, free Trainees of membership payments (including offering scholarships) and make changes deemed necessary regarding membership fees. The Gym has the right to change their price list without prior warning at all times.

 

3.9 Membership fee guarantees the membership of the Gym. Membership applies only to the period for which the payment has been made and ends on the following day of that period. When extending the membership fee the day after the previous membership’s end is counted as the new beginning period unless stated otherwise in the payment details. Membership is personal and only applies to the person in whose name the payment has been made. The Gym has the right to ask for identification to ascertain the identity of the Trainee.

 

 

4. OTHER

 

4.1 Before starting trainings the Trainee must be aware of their physical condition and must make sure that the trainings are suitable and safe for them. If necessary, the Trainee should consult a doctor before starting trainings. The Gym is not responsible for any injuries or traumas received during training. The Gym is not responsible for the physical health of the Trainee.

 

4.2 Training must support the all-round health of the Trainee, including their mental, physical, and social well-being. The Gym’s representative has the right to forbid trainings to the Trainee if they believe trainings are endangering the Trainee’s health or well-being. The Gym’s representative has the right to give recommendations for the Trainee to consult a doctor or other specialists. If the condition of the Trainee does not improve the Gym has the right to remove the Trainee from trainings indefinitely. In this case the membership fee/beginners’ course fee is not refunded or compensated to the Trainee.

 

4.3 The Gym is not responsible for the personal belongings of the Trainee.

 

4.4 Children under the age of 15 need the permission of their parent or guardian to be in the training hall during trainings. Children are not allowed on the mats during trainings.

 

4.5 The Gym has the right to film and photograph the Trainee during trainings and use the footage at its sole discretion.

 

4.6 All trainees are polite, tolerant, and attentive to others. They are the representatives of the Gym’s values and beliefs. Trainees value a healthy lifestyle, promote fight sport and keep the good name of the Gym in high regard. The Gym’s representative has the right to deny training to the Trainee in the case of not following the Conditions and/or Internal Rules of the Gym, acting inappropriately, damaging the reputation of the Gym, and in the case of a serious breach of the Gym’s values and beliefs. In these cases the contract between the Gym and the Trainee is unilaterally terminated. In the case of unilateral termination of contract the payment fees (membership fee, beginners’ course fee, and one-time training payment) is not refunded or compensated to the Trainee.

 

4.7 The Gym’s representative has the right to deny trainings to individuals who are believed to damage the Gym’s reputation, whose public affairs are in opposition to the Gym’s values, or who endanger the health and/or well-being of themselves or other Trainees.

 

4.8 The Gym reserves the right to claim compensation for all damages caused to the Gym.

 

4.9 The Trainee stays informed of all activities of the Gym via their website and/or email.
